What Constitutes Domestic Violence?

Kansas defines a crime of domestic violence as a defendant’s act or threat of violence against a person who is a family or household member or a current or former dating partner. • Domestic battery – Class B misdemeanor punishable by 48 hours to 6 months in jail and/or $200-$500 in fines; a second offense within 5 years is a Class A misdemeanor punishable by 90 days to 1 year in jail and $500-$1,000 in fines; a third or subsequent offense within 5 years is a felony punishable by 90 days to 1 year in jail and $1,000-$7,500 in fines
• Aggravated domestic battery – severity level 7 felony punishable by up to 13 months in prison and $100,000 in fines
• Assault – Class C misdemeanor punishable by up to 30 days in jail and a $500 fine
• Stalking – Class A misdemeanor punishable by up to 1 year in jail and $2,500 in fines
• Violating a protective order – Class A misdemeanor punishable by up to 1 year in jail and $2,500 in fines

Individuals convicted of domestic violence will also lose their rights to possess firearms for at least 5 years following the conviction.
